Description
Intellectual property is at the core of most life sciences businesses. As a result, issues involving patents often find their way into seemingly unrelated areas of legal practice. This program will provide information that every life sciences lawyer should know about how his/her practice may be affected by patent law issues, as well as the impact that the practice may have on clients' intellectual property. Topics will include, among others, the Hatch-Waxman Act; pending biosimilars legislation and the patent issues this creates with follow-on biologics; the way in which representations made to the FDA can impact the scope and enforceability of patent rights; when a clinical trial amounts to a "public use" in a manner that may undermine patent rights; and pending patent reform legislation.
